The petitioner seeks bail in connection with Beur P.S. Case No. 92 of 2023 registered for the offence under Sections 302/34 of the Indian Penal Code.

The accused/petitioner is not named in the F.I.R. and is in custody since 10.02.2023.

The allegation against the petitioner is to commit murder of one lady, aged about 62 years old, name unknown, where, death appears by causing assault with brick plates, stone, etc.

Learned counsel appearing on behalf of the petitioner submitted that the name of this petitioner surfaced, on

No.32663 of 2023(3) dt.26-07-2023 2/3 the basis of suspicion, as he found roaming, around the place of occurrence, as per CCTV Footage and nothing incriminating appears against this petitioner, as to connect him, prima facie, with present occurrence of murder. While concluding the argument, it is submitted that petitioner found involved in 01 more case, where, he is on bail and moreover, investigation of this case is completed, for which, charge-sheet has already submitted, as such, there is no chance of tampering with the evidence.

Learned APP appearing on behalf of the State, opposes the prayer of bail.

Considering the facts and circumstances as mentioned above and taking note of the fact as save and except roaming around place of occurrence, as per CCTV Footage, no incriminating material appears against this petitioner, as to connect him, prima facie, with present occurrence of murder coupled with the fact that charge-sheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Beur P.S. Case No. 92 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna concerned court,
