The petitioners seek bail in a case registered under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and 66 of I.T. Act.

The prosecution case, in brief, is that in course of a raid of orchard, seeing the police party, 7-8 persons, present there started fleeing away but these petitioners were apprehended and in course of search, inside the banyan, 8 pages order sheet were recovered.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.31554 of 2019(2) dt.14-05-2019 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 26-03-2019. The petitioners have been falsely implicated in the present case. There is no other substantive evidence to suggest the implication of the petitioners in the present case. There is no recovery of any incriminating article from possession of the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nalanda at Bihar Sharif in connection with Giriyak (Katrisarai) P.S.
