2. Petitioners seek regular bail in connection with Masaurhi P.S. Case No. 182 of 2026 registered for the offence punishable under sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita.
3. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated due to village rivalry and pathway dispute between the parties. It is submitted that the informant is not an eyewitness and no witness has seen the petitioners with the deceased. Learned counsel further submits that no specific overt act has been attributed against the petitioners and their implication in the present matter is merely based on suspicion. Petitioner no. 1 is a lady and two small children are in custody with her, while petitioner no. 2 is also a lady suffering from ailments. Petitioner no. 1 has no criminal antecedent and petitioner no. 2 has one criminal antecedent in which she is on bail.
4. Learned APP for the State has opposed the prayer of the petitioners.
5. In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the facts that the petitioners are ladies and it is not the case of the prosecution that the petitioners had called the deceased, and further, no specific role of the petitioners in the alleged crime of murder has been attributed to them in the FIR, this Court is inclined to release them on bail. Accordingly, let the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the court concerned in connection with Masaurhi P.S. Case No. 182 of 2026.
