JUSTICE SANDEEP KUMAR ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks regular bail in connection with Kumarkhand P. S. Case No. 365 of 2022 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the there is recovery of 166.100 litres of illicit liquor and also the petitioner is in custody since 13.04.2023. The petitioner has no criminal antecedent.

Learned APP has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.32725 of 2023(2) dt.23-05-2023 2/2 Considering the nature of allegation levelled against the petitioner and his clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge- 5th -cum-Special Judge Excise 1st , Madhepura in connection with Kumarkhand P. S. Case No. 365 of 2022.
