2. The petitioner apprehends his arrest in connection with Amarpur P.S. Case No. 566 of 2022, instituted under Sections 379, 411, 353, 307/34 of the Indian Penal Code, Section 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rule, 2019, Section 21 of Mines and Minerals (Development and Regulation) Act, 1957 and Section 15 of Environment Protection Act, 1986.

3. As per the prosecution case, during course of patrolling informant/ S.H.O., Amarpur P.S. and his team intercepted a sand loaded tractor near Dumariya More and apprehended its driver Mangal Tanti. Petitioner along with other accused persons are alleged to have started manhandling with the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is neither driver nor owner of the tractor. He has no concern with the said occurrence. Name of the petitioner has come in this case on the basis of confessional statement of Mangal Tanti. Petitioner has no criminal antecedent. Petitioner undertakes to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 566 of 2022, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
