====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-08-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354, 506/34 of the Indian Penal Code.

3. As per prosecution case, co-accused Sakaldeep Yadav and petitioner No. 2 caught hold of the informant from back and petitioner No. 1 gave iron rod blow on his head due to which the informant sustained head injury. It is further alleged that they also assaulted the mother of the informant

4. It is submitted that the doctor has found the injury to be simple in nature. Case and counter case. There is delay of

Patna High Court CR. MISC. No.36171 of 2023(3) dt.07-08-2023 2/2 four days in lodging the F.I.R. without any plausible explanation for the same. Petitioners have got clean antecedent.

5. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Darbhanga in connection with Keoti P. S. Case No. 43 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
