The petitioners seek bail in a case instituted for the offences under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 25(1-B)AA, 26 and 35 of the Arms Act. Prosecution case, in short, is that two country made pistols and 17 cartridges from the dilapidated house and one rifle along 30 cartridges are recovered from the heap of straw. It has been submitted on behalf of the petitioners that the petitioners are in custody since 2.2.2019. Charge-sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that two

No.30964 of 2019(3) dt.11-07-2019 2/2 country made pistols and 17 cartridges are recovered from the dilapidated ancestral house of the petitioners and one rifle and 30 cartridges are recovered from the heap of straw in an abandoned state. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Barh, Patna in connection with Barh P.S. Case No. 50 of 2019.
