JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Makhdumpur P.S. Case No. 404 of 2010, dated 31.12.2010, instituted for the offences under Sections 392/174(A) of the I.P.C.

Though the name of the petitioner has transpired only in the confession of arrested co-accused persons, but considering the tainted background of the petitioner, I am not inclined to grant anticipatory bail to him. The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, should the petitioner surrender before

Patna High Court Cr.Misc. No.66460 of 2018(2) dt.14-12-2018 2/2 the Court below within a period of four weeks and seek regular bail, the Court below shall consider the case on its own merits without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
