2. The petitioners are apprehending arrest in connection with Amarpur (Fullidumar) P.S. Case No. 422 of 2024, dated 26.06.2024, lodged under Sections 341, 323, 308, 504, 506, 379/34 of the IPC.

3. As per the prosecution case, the FIR has been

No.30710 of 2025(2) dt.15-05-2025 2/3 lodged against seven named accused persons (all petitioners) alleging therein that they have injured the informant by means of Lathi and rod. It is further alleged that Rs. 500/- was also snatched from the father of the informant namely, Chhabilal Yadav. On the intervention of neighbours, the accused persons fled away.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that there is a land dispute between the parties and all the petitioners have got clean antecedent. It is also submitted that it is a case of Sections 308 and 379/34 of the IPC but there is no ingredient as such to make out the case under these Sections of the IPC. Learned counsel further submits that there is a case and counter case inasmuch as petitioner no.1, namely Ram Bilash Yadav has filed a case against the informant under various Sections bearing Amarpur (Fullidumar) PS Case No. 423 of 2024.

5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that there is a case and counter case between the parties and a minor scuffle took place between them.

6. As such, in the present facts and circumstances of

No.30710 of 2025(2) dt.15-05-2025 3/3 this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Banka in connection with aforesaid P.S. Case subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
