The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 452, 379, 504, 506/34 of the Indian Penal Code.

As per the prosecution case, on 07.08.2021 at about 11 PM, while the informant was sleeping alone at her house, petitioner alongwith other F.I.R. named accused entered her house and slapped her and thereafter, committed indecent assault.

It is submitted on behalf of petitioner that petitioner is none else, but own father-in-law of the informant and due to petty family dispute, a false and concocted case has been lodged. Similarly situated co-accused Arvind Kumar has already been granted anticipatory bail by a coordinate Bench, vide order dated 11.11.2022 passed in Cr.Misc. No. 31850 of 2022.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria P.S. Case No. 627 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
