====================================================== CORAM: HONOURABLE MR. JUSTICE RAJ KUMAR ORAL ORDER 15-07-2026 Heard learned counsel for the petitioner as well as the Additional Public Prosecutor appearing on behalf of the State.
2. Petitioner being mother-in-law of deceased is in custody since 19.02.2026 for the offence punishable under Sections 80, 103(i), 3 (5) of BNS
3. The allegation in the FIR is that the daughter of the informant was married with one Md. Muzaffar Alam and after the marriage there was demand of dowry and torture and for that she was allegedly killed.
4. Learned counsel for the petitioner has submitted that the petitioner happens to be mother-in-law of the deceased with no specific allegation against her. It is next submitted that the details regarding allegations of dowry have not been mentioned in the FIR, learned counsel further submits that the
Patna High Court CR. MISC. No.32677 of 2026(3) dt.15-07-2026 2/3 deceased allegedly committed suicide by consuming celphos tablet. Lastly it is submitted that the husband of the deceased namely Md. Muzaffar Alam (co-accused) has already been granted bail by this Court in Cr. Misc. No. 31144/2026 on 01.07.2026.
5. Learned APP on behalf of the State has also not disputed this fact that the husband (co-accused) has been enlarged on bail, he has also referred to the FSL report of the deceased.
6. Taking into consideration the facts and circumstances of the case, the petitioner is the mother-in-law of deceased and husband has already been enlarged on bail by coordinate Bench of this Court, this Court deems it proper to extend the relief to the petitioner.
7. Accordingly, the application is allowed.
8. The Petitioner herein is directed to be released on bail on furnishing bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Court of Ld. Mr. Randhir Kumar, J.M.F.C. Kishanganj in connection with Terhagachh P.S. Case No. 201 of 2025, subject to the following conditions:- (i) The petitioner shall co-operate in the disposal of trial.
Patna High Court CR. MISC. No.32677 of 2026(3) dt.15-07-2026 3/3 (ii) One of the bailors must be close relatives of the petitioner such as mother, father, brother, sister, or wife. (iii) The petitioner will appear on each and every date fixed by the trial Court and if, he fails to do so on tow consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.
