The petitioner being husband of the victim is languishing in custody since 15.04.2013 in a case registered for the offences punishable under Sections 304(B)/34 of the I.P.C and 3⁄4 of the Dowry Prohibition Act.

The accusation is killing the sister of the informant after one and half years of marriage for nonfulfilment of dowry demand. It is specifically alleged against the petitioner that petitioner on 26.01.2013 came along with his friends and forcefully took the sister of the informant from informant's house and killed her on 08.02.2013. It is submitted by learned counsel for the petitioner that bona fide of the petitioner is apparent from the fact that brother of the petitioner informed the informant about

Patna High Court Cr.Misc. No.33539 of 2014 (3) dt.27-01-2015 2/2 the illness of the victim.

Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner. Accordingly the application is dismissed in connection with Sessions Trial No. 324 of 2014, arising out of Barachatti(Mohanpur) P.S. Case No. 45 of 2013. Let the trial be expedited.
