The petitioners are apprehending their arrest in a case registered under Sections 120(B) of the Indian Penal Code and 7 of Essential Commodities Act.
The prosecution case, in brief, is that a truck loaded with
Patna High Court Cr.Misc. No.66348 of 2018(2) dt.14-12-2018 2/3 243 rice bags each containing 50 kg. of rice was apprehended. On demand, co-accused Shoib Alam failed to produce any document regarding seized rice.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. The petitioners are not named in the FIR. The name of the petitioners has transpired in this case on the disclosure made by co-accused Shoib Alam. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioners in the present case. Petitioners are agriculturists. The allegation is that the petitioners had sold the rice in question to the co-accused.
On behalf of the State, it is submitted that the petitioners are not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial
