JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-10-2018 The present petition has been filed for modifying the order dated 09.02.2018 passed in Cr.Misc. no. 58374 of 2017 to the extent that the petitioner be exempted from marking his presence before the officer-in-charge of the concerned PS. The learned counsel for the petitioner submits that now the charge sheet has been filed and the learned trial court has also taken cognizance, hence the petitioner can be exempted from marking his attendance before the concerned PS, however the petitioner undertakes to appear before the learned trial court on each and every date, so fixed.

In view of the aforesaid submission made by the learned counsel for the petitioner, the order dated 09.02.2018 passed in Cr.Misc. no. 58374 of 2017 is modified to the extent that

Patna High Court Cr.Misc. No.63492 of 2018 (2) dt.10-10-2018 2/2 "now the petitioner is not required to mark his presence before the officer-in-charge of the concerned PS and instead, the petitioner shall attend the court proceedings regularly in connection with Ujiarpur PS case no. 147 of 2017 subject to just exceptions ". The petition stands disposed of.
