The petitioners seek bail in anticipation of their arrest in connection with Revelganj P. S. Case No. 103 of 2018 dated 10.04.2018 instituted for the offences under Sections 147, 323, 341, 188, 353, 427, 431 and 283 of the Indian Penal Code and Sections 3 and 4 of the Public Property Damage Act, 1984.

The petitioners are said to have indulged in loot and arson on the day of Bharat Band staged in protest against the recoiling of the amendments in the SC/ST (Prevention of Atrocities) Act.

Patna High Court Cr.Misc. No.64056 of 2018(2) dt.13-12-2018 2/2 Learned counsel for the petitioners has submitted that the names of the petitioners have been given by local persons to feed-fat old grudge. The petitioners were only bystandards and have wrongly been made accused in this case. Petitioner nos. 2 to 5 do not have any criminal antecedents. Petitioner no. 1, however, is an accused in a case of minor offence.

Considering the general nature of allegation against the petitioners, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-VIII, Saran at Chapra in connection with Revilganj P. S. Case No. 103 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
