2. In the present case, the petitioner is apprehending his arrest in connection with Sonbarsa Raj P.S. Case No. 194 of 2024 registered for the offences under Sections 126(2), 115(2), 308(2), 352, 351(2), 351(3), 3(5) of B.N.S., 2023.

3. As per prosecution case, the petitioner and other co-accused persons came to the house of the informant and hurling abuses, demanded Rs.15 Lakhs as extortion money and demand of Rs.50,000/- per month was also made.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.32222 of 2025(2) dt.21-05-2025 2/3 case. There is old enmity between the parties and the informant has implicated the petitioner in another case with similar allegation. The wife of co-accused Chhotelal Kamat has filed Complaint Case No. 1243 of 2025 against the informant and others. Learned counsel further submits that the petitioner is a teacher and there is no specific allegation against him for any wrongful act except for the allegation of demanding money and extortion along with other co-accused persons.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation against the petitioner and also considering the possibility of false implication, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa/concerned court in connection with Sonbarsa Raj P.S. Case No. 194 of 2024, subject to the condition as laid down under Section 482(2) of the B.N.S.S. and other following

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
