Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the Informant.

The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act. 3.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that while he was going to Chaksikander Station to catch a train for Patna, four accused persons including petitioner and 2-3 unknown persons caught him and took him behind the station and tried to snatch his belongings, on protest being raised by the informant, Puran Rai took out his pistol and fired upon the informant which hit his elbow as a result of which he became

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case. It is also submitted that a learned Co-ordinate Bench has been pleased to grant regular bail to Puran Rai by an order dated 3-12024 in Cr. Misc No. 72450 of 2023. It is next submitted that allegation of firing is against Puran Rai and as far as this petitioner is concerned, the allegation against him is general and omnibus in nature and petitioner is languishing in custody since 24-3-2024. It is also submitted that petitioner will not abscond rather will cooperate in the investigation.

Learned A.P.P. for the State and learned counsel appearing on behalf of the informant oppose the prayer for bail of the petitioner but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that Puran Rai has been granted the privilege of bail by a Co-ordinate Bench.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is

One of the bailors of the petitioner shall be his father, Malik Rai @ Tejnarayan Rai 8.

However, it is made clear that in the event if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial court shall be at liberty to forthwith cancel the bail bonds of the petitioner after recording reasons.
