This application for regular bail arises out of Dehri(T)(Indrapuri O.P.) P.S. Case No. 301 of 2020, disclosing offence punishable under Section 307 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act and subsequently Section 302 of the IPC has been added. It is the prosecution's case that unknown miscreants on the alleged date of occurrence i.e. 25.04.2020 started indiscriminate firing on the husband of the informant because of which he succumbed to death. The FIR was registered against unknown. During the course of investigation one Bimlesh Kumar was apprehended who confessed his active participation

Patna High Court CR. MISC. No.31553 of 2020(4) dt.11-01-2021 2/2 in commission of the offence and disclosed petitioner's complicity also. It transpires from the case diary that the police during the course of investigation collected call detail reports of all the accused persons which indicate that the miscreants, whose names surfaced after confessional statement of coaccused Bimlesh Kumar, were in constant touch with each other before and soon after the commission of offence. Disclosure made by the co-accused Bimlesh Kumar in his confessional statement is corroborated by the call detail reports. Considering the gravity of the offence alleged, I am not inclined to grant the petitioner privilege of regular bail for the present.

This application is accordingly dismissed.
