The petitioner has preferred this application for grant of regular bail in a case registered under sections 406 and 420 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that the petitioner took Rs. 3 lacs from him on the false promise that he would be made a partner in running of the petrol pump and it subsequently transpired that he had cheated others also. The petitioner is not ready to return the said amount. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From the contents of the FIR itself it would transpire that the nature of the dispute is purely civil in nature. The petitioner is in custody since 19.2.2021 and has no criminal antecedent. Having heard learned counsel for the parties and taking into consideration the facts of the case together with chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Kurtha P.S. Case no. 25 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal.
