2. The petitioners apprehend their arrest in connection with Pranpur P.S. Case No. 05 of 2024 for the offence registered under sections 341, 323, 326, 307, 379, 427, 504 and 34 of the Indian Penal Code lodged on 06.01.2024 by the informant, Sikandar Mandal.
3. As per the prosecution story, the informant alleged that the petitioners along with other accused persons armed
Patna High Court CR. MISC. No.35076 of 2024(3) dt.31-07-2024 2/2 variously came to his house and assaulted him and his family members, causing injury. The injured persons were taken to the hospital for treatment. Further, allegation is of damaging the informant's motorcycle and taking away of cash and jewellery. Accordingly, the F.I.R.
4. Learned Counsel for the petitioners submit that the allegation is/are omnibus in nature.
5. Learned APP on the other hand submits that the injury has been found to be grievous in nature (Annexure-4).
6. Considering the allegation of initial assault that has come against the petitioners coupled with the fact that the injury has been found to be grievous in nature, no relief can be granted.
