Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Biraul P.S. Case No. 52 of 2022 lodged under Sections 302/34 of the I.P.C.

As per the prosecution case, six years ago marriage of informant's daughter has been solemnized with Surrendra Yadav.

Learned counsel for the petitioner submits that the said Surrendra Yadav and all his family members including the present petitioner, caused death to informant's daughter. With this allegation the F.I.R. has been lodged.

Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 17.02.2022 having clean antecedent and charge

Patna High Court CR. MISC. No. 32682 of 2022(3) dt.01-12-2022 2/2 sheet has already been filed in this case. He further submits that this case has been lodged under Section 302/34 of the I.P.C. but charge-sheet has been filed under Section 306/34 of the I.P.C. Learned counsel for the petitioner submits that the final form has been submitted and cognizance has been taken under 306/34 of the I.P.C.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Magistrate, i.e. Additional Chief Judicial Magistrate - I, Biraul, Darbhanga in connection with Biraul P.S. Case No. 52 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
