The petitioner is languishing in custody in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code and Section 8 of the POCSO Act.

It is alleged by the petitioner that he kidnapped the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is next door neighbour of the informant and he had not kidnapped

Patna High Court CR. MISC. No.33056 of 2023(2) dt.03-07-2023 2/2 the victim girl. The victim in her statement recorded under Section 164 Cr.P.C has not alleged anything against the petitioner. The petitioner is languishing in custody since 25.10.2022. A statement has been made in para 3 of the petition that petitioner has one other criminal antecedent apart from the present one which has been lodged by the same informant.

Considering the fact aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VII-cum-Special Judge, POCSO Court, Bhagalpur in connection with Rasalpur P.S.
