The petitioner seeks bail in connection with Mahila P.S. Case No. 3 of 2021, registered for offence punishable under Section 376 of the Indian Penal Code and Section 4 of POCSO Act.

Learned counsel for the petitioner submits that the girl in her medical examination has found major and in the FIR as well as statement made under section 164 of Cr.P.C., the victim has not made any allegation against the petitioner. Learned counsel for petitioner further submits that main accused, namely, Jumman Kuraishi, who has said to have committed rape and granted bail vide order dated 20.09.2021 passed in Cr. Misc. No. 23614 of 2021.
