No. 2 and his other family members have challenged the order dated 14.01.2013 passed by the learned Chief Judicial Magistrate, Patna in Phulwarisharif P.S. Case No. 363 of 2012 whereby cognizance has been taken under Sections 498A/34 of the Indian Penal Code.
The learned counsel for the petitioners is not in a position to inform this Court about the stage of the case.
Patna High Court CR. MISC. No.12637 of 2015(4) dt.08-05-2019 2/2 If the trial has not begun, the petitioners have the option of availing of the remedies which are available to them under the law. Otherwise also, the petitioners can always request the Court for making efforts for settlement of dispute and for referring the matter to the mediation centre.
The petitioner No. 1, either himself or along with his wife can approach the concerned Court for settlement of matrimonial dispute, if so desired and advised.
However, this Court on going through the materials on record is not inclined to interfere with the order of cognizance which has been passed in the year 2013.
The petition is dismissed.
