This application for anticipatory bail arises out of Hajipur Sadar P.S. Case No. 736 of 2019 for the offence punishable under Sections 302/120-B/34 of the Indian Penal Code.

Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no.2 namely, Virendra Kumar @ Vijendra Sah, as he has been arrested.

Accordingly, this bail application is dismissed as withdrawn as against petitioner no.2 namely, Virendra Kumar @ Vijendra Sah.

Patna High Court CR. MISC. No.2398 of 2021(2) dt.15-11-2021 2/2 Learned counsel for the petitioners has brought on record order dated 25.01.2021 passed in Criminal Miscellaneous No.28558 of 2020, by which a similarly situated co-accused has been granted anticipatory bail by a coordinate Bench of this Court after considering the materials available on record. This Court finds no reason to differ with the said order.

For the reasons mentioned in the order dated 25.01.2021 passed in Criminal Miscellaneous No. 28558 of 2020, this bail application is allowed. Let the petitioner nos.1 and 3, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 736 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
