Petitioner is apprehending his arrest in connection with Laxmipur PS Case No. 29/2017 for the alleged offence under Sections 147, 148, 149, 307 and (later on) 302 of the Indian Penal Code and Section 3/ 4 of the Explosive Substance Act.

Having regard to the fact that trial in the instant case has concluded so far as the other persons are concerned, this Court is not inclined to grant anticipatory bail to the petitioner. Learned counsel representing the petitioner submits that during the trial no witness has deposed against this petitioner. The aforesaid plea may be a good ground while considering the case of the petitioner for grant of regular bail.

No.64439 of 2018(3) dt.20-12-2018 2/2 In the event the petitioner above named surrenders before the court below within a period of one month from today and prays for regular bail, the court below is directed to dispose of the application for regular bail on the same day. The trial court is also directed to examine whether any material in the trial in connection with Sessions Trial No. 84/2018 has come against the petitioner or not.
