The petitioner seeks regular bail in connection with Murar. P.S. Case No. 07 of 2021, dated 30.01.2021, registered under Sections 392 of the Indian Penal Code.
Learned senior counsel for the petitioner further submits that from perusal of the F.I.R., it would manifest that informant alleges that his bag was snatched containing 2,80,000/- (Two lacs Eighty thousand) by three unknown masked miscreants on gun point alongwith laptop and Vivo mobile. Learned senior counsel submits that F.I.R. was against unknown, name of the petitioner transpired on information given by the police spy and on basis of which the petitioner was arrested and the petitioner in his confessional statement
Patna High Court CR. MISC. No.41947 of 2021(2) dt.14-12-2021 2/2 accepted his participation in the occurrence and at his instance the bag which is alleged to have been snatched was recovered. Learned senior counsel submits that though there is allegation that based on the confessional statement of the accused the bag was recovered, but the bag was not put on T.I. Parade nor it has been identified or claimed by the informant. Petitioner is in custody since 09.03.2021, and is a person with clean antecedent and charge-sheet has been submitted.
Learned APP for the State opposes the prayer of regular bail application of the petitioner.
Considering the fact that the petitioner is in custody since 09.03.2021, charge-sheet has been submitted in this case and the bag was not put on T.I. Parade and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Court of Judicial Magistrate-1st Class, Buxar, Bihar in connection with Murar. P.S. Case No. 07 of 2021.
