The petitioner seeks bail in Forbesganj P.S. Case No.991 of 2019 registered under Section 394 of the Indian Penal Code.
The informant alleged that three motorcycle borne criminals came and intercepted the informant on the point of pistol. The accused assaulted him with pistol on his head and another accused snatched his chain made of silver, J7 Samsung mobile having Sim No.6284396716 and Rs.1000/- cash. The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. During the course of investigation, one Md. Rahbar was arrested and he is said to have disclosed the name of the petitioner on such, the petitioner was arrested on 24.05.2020 but the petitioner has not been put
Patna High Court CR. MISC. No.31500 of 2020(2) dt.02-12-2020 2/2 on T.I.P. as yet. No looted article was recovered from the possession of the petitioner. Save and except the confession, there is no tangible material on record to show that the petitioner is involved in robbing the informant. It appears that of course the name of the petitioner surfaced in the case in the confessional statement of co-accused Md. Rahbar and on such, the petitioner was arrested on 24.05.2020 but nothing has been recovered from the possession of the petitioner and petitioner was not put on T.I.P. and petitioner is in jail for more than six months. Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Forbesganj P.S. Case No.991 of 2019/G.R. No.3722 of 2019.
