2. The petitioner is apprehending arrest in connection with Complaint Case No. 1572c/2024 instituted under Section 85 of the B.N.S. and 4 D.P. Act.

3. Though, the notice was earlier sent to the opposite party no.02, the office notes record that she has personally received the notice but no representation is there.

4. As per the prosecution story, the marriage took place in the year 2018 but she was always tortured for dowry, in the year 2019, she gave birth to a female child whereafter, the torture increased and finally, she was ousted in the year 2023. This followed the complaint/cognizance.

5. Learned counsel for the petitioner submits that he still wants to keep his wife with full dignity and honour as she is

However, she has failed to appear, on his own would like to contribute Rs.4000/- for the lady and Rs.2000/- for the child (Rs.6000/-) per month which will go to her account by 10th of every month and failure to do so, she can take steps for cancellation of bail bond, if relief is granted.

6. Learned APP opposes the prayer submitting that he has gone for the second marriage.

Considering the submissions of the parties as also that this petitioner wants to financially assist the lady and the child and that he has no criminal antecedent, in that background, this Court is inclined to extend him the privilege of anticipatory bail subject to payment of Rs.4000/- for the lady and Rs.2000/- for the child (Rs.6000/-) per month which will go to her account by 10th of every month and failure to do so, she can take steps for cancellation of bail bond.

Let the petitioner be released on bail, in the event of his arrest or surrender before the concerned court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each in connection with Complaint Case No. 1572c/2024 to the satisfaction of learned S.D.J.M., Begusarai subject to the conditions as laid down under Section 438(2) of

Patna High Court CR. MISC. No.33390 of 2026(4) dt.23-07-2026 3/3 the Cr.P.C. as also the other conditions.

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Driving License/Voter ID/Pan Card etc.) to show his/her bona fide;

(ii) the petitioner shall be appearing before the police station as and when required for cooperating in the investigation;

(iii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
