2. The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366A of the Indian Penal Code and Section 8 of the POCSO Act.

3. As per the prosecution case, petitioner has taken away the sister of the informant with wrong intention and there is apprehension that the petitioner will do wrong with her.

4. It is submitted on behalf of petitioner that the victim in her statement recorded under Section 161 Cr.P.C. stated that she has gone with petitioner on her free will. The petitioner has not kidnapped her. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer

Patna High Court CR. MISC. No.35834 of 2023(3) dt.08-09-2023 2/2 for anticipatory bail.

6. Considering the aforesaid facts and circumstances and the statement made by victim under Section 161 Cr.P.C. , in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-VI-cum-Spl. Judge (POCSO), Jehanabad, in connection with Kako P.S. Case No. 21 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
