2. Petitioners seeks regular bail in a case registered for the offence punishable under sections 8/20(b)(ii)(B) of the NDPS Act and sections 317(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, 17.745 kilograms ganja was recovered from possession of these petitioners who were arrested while fleeing away from the vehicle.

4. It is submitted on behalf of the petitioners that these petitioners are innocent and have falsely been implicated in this case because they have inimical terms with seizure list witnesses. As a matter of fact, no incriminating article has been recovered from their conscious possession and they have not been arrested from the spot as alleged, rather recovery of ganja

Patna High Court CR. MISC. No.31370 of 2025(3) dt.18-09-2025 2/3 has been made from the vehicle of which they are neither driver nor owner. Petitioners claim clean antecedent. Petitioners are in custody since 11.2.2025. Charge sheet has also been submitted in the case.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the nature of accusation and period of custody, prayer for bail of both these petitioners is allowed. Let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Principal Sessions Judge, Gopalganj in Kuchaikote Police Station Case No. 62 of 2025.
