Permission is accorded.

If the petitioner surrenders before the Court below and seeks regular bail, the Court below shall consider the case on its own merits, taking into account that there has been recovery of five litres of liquor from a joint house inhabited by twelve persons, and shall pass order in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
