The petitioner seeks bail in Khagariya (Chitraguptanagar) P.S. Case No. 977 of 2020, registered for the offence punishable under Sections 406, 420 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner introduced the informant with the co-accused and stated that in Dwarika area, Delhi Smart City is going to be developed and project has been passed and it will be developed by Revanta Multi State CGHS Ltd. and the Chairman of the Company is Satyendra Man and Treasurer of the Company is Pradip Sherawat and Suresh Chandra is one of the Member. Informant gave Rs. 17,80,900/- through cheque and cash for allotment of flat to the co-accused, but neither flat was allotted to him nor money was returned to him even after lapse of five years.

Petitioner is in no way connected with the company. Petitioner has not received any single farthing from the informant or any money has been transferred in his account by the informant. Petitioner is in custody since 26.03.2021 having clean antecedent. Investigation is complete.

However, counsel for the informant vehemently opposed the prayer for bail and submitted that during course of investigation it has come that there was phone call by the informant to accused and cassettes was prepared and accused petitioner confessed his guilt and confessed that Rs. 200 crore out of Rs. 400 crore has been taken by him in the project. Considering the nature of allegation and period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagariya in connection with Khagariya (Chitraguptanagar) P.S.
