2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 67/67A of the IT Act.
3. Petitioner is alleged to have threatened the informant to make viral her video.
4. Learned counsel appearing for the petitioner submits that as a matter of fact wife of the petitioner won the election of Ward Councilor against the informant and so due to political rivalry, the petitioner has falsely been implicated in this case. Mobile numbers mentioned in the FIR do not belong to the petitioner.
5. Learned counsel for the State as well as the
Patna High Court CR. MISC. No.34020 of 2023(2) dt.25-07-2023 2/2 informant oppose the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Chhatauni Police Station Case No. 42 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
