2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 112(2) and 3(5) of the B.N.S. r/w Section 10 of Bihar Acharan Priksha Adhiniyam, 1981.

3. The case of the prosecution, in short, is that the petitioner was appearing in the examination in place of one Shobhi Kumar. On being asked, the petitioner has disclosed that Sonal Kumari and Rajeev Kumar have given him Rs. 50,000/- for this assignment.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Learned counsel for the petitioner has

Patna High Court CR. MISC. No.31657 of 2026(2) dt.23-06-2026 2/2 submitted that the petitioner was apprehended as he was appearing in the examination in place of one Shobhi Kumar. Petitioner is languishing in judicial custody since 22.01.2026.

5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Sheikhpura (incharge of C.J.M., Sheikhpura) in connection with Sheikhpura P.S. Case No. 14 of 2026 with the condition that petitioner shall not indulge himself in similar nature of offences in future.
