The petitioner apprehends his arrest in Excise Case No.120C2 of 2020 registered under Section 30(a)(c) of the Bihar Prohibition and Excise Act.

The informant alleged that after having received secret information that the petitioner had kept liquor in his house raided the house of the petitioner but the petitioner after seeing the police managed to flee away. On search, 40 litres of country made liquor and 180 kg of Gur meant for preparing liquor was recovered from the house of the petitioner. The other utensils were recovered. One Bikram Sahni was also arrested. Learned counsel for the petitioner submits that the petitioner is innocent and he has, in fact, committed no offence.

For recovery of liquor, etc. from a joint house, only petitioner cannot be held to be responsible, but it appears that from the house of the petitioner besides 180 kg of Gur meant for preparing liquor, 40 litres of country made liquor was also recovered.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
