The petitioner is in custody since 21.9.2013 in connection with Sessions Trial No.12/14 arising out of Purnahiya P.S. Case No.31 of 2013 registered for the offences under Sections 341, 323, 324, 307 and 302 of the Indian Penal Code. The allegation against the petitioner is that he along with other participated in the occurrence and as a consequence thereof, one Bindu Manjhi was killed.
Learned counsel for the petitioner submits that earlier this petitioner had himself sustained serious injuries inasmuch as the informant side had attacked the petitioner with the knife leading to injury in his stomach. In this connection, the
Patna High Court Cr.Misc. No.33838 of 2014 (4) dt.02-03-2015 2/2 petitioner's wife Rambha Devi has also filed Purnahiya P.S. Case No.34 of 2013 dated 12.5.2013.
Considering the nature of the case and also that the petitioner has also sustained injuries as per details in the F.I.R. (Annexure 2) and also the fact that the petitioner has no criminal antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Sheohar, in connection with Sessions Trial No.12/14 arising out of Purnahiya P.S.
