JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Amas P.S. Case No. 186 of 2018, dated 03.08.2018, instituted for the offences under Sections 272 and 273/34 of the I.P.C and Section 30(a) (d) of the Bihar Prohibition and Excise Act, 2016.

On secret information that country made liquor is being manufactured in village Bihari Bigha, a raid was conducted. At the time of raid, many persons working at the local brewery started running away. Two of such persons,

Patna High Court Cr.Misc. No.66453 of 2018(2) dt.14-12-2018 2/3 viz., Shankar Bhuiyan and Judge Chaudhary were arrested. They disclosed that after coming out from jail, they have involved themselves in manufacture of country made liquor and named others also who were involved in the aforesaid trade. In the process of naming their associates, the aforesaid two arrested accused persons have named the petitioner also along with fourteen others.

The learned counsel for the petitioner has submitted that but for the statement of aforesaid two arrested accused persons, there is no other material to connect the petitioner with the crime. The falsity of the case further appears from the fact that the petitioner has clean antecedents.

For the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special
