JUSTICE HEMANT KUMAR SRIVASTAVA ORAL JUDGMENT Date : 21-12-2019 At the very outset, learned counsel Sri Satish Kumar appearing for the appellants submits that parties have already settled their dispute outside the court and an interlocutory application bearing I.A. No. 04 of 2019 has been filed under Order XXIII Rule 3 of the Civil Procedure Code praying therein to dispose of this appeal in the light of terms and conditions of the agreement arrived at between the parties which has been annexed as Annexure-1 to I.A. No. 04 of 2019.
Learned counsel Sri Anant Kumar Bhaskar appearing for the respondents concedes the above stated submission of learned counsel of the appellants and submits that parties have settled their dispute outside the court and, therefore, this appeal may be disposed of in the light of terms and conditions of agreement arrived at between the parties.

No. 04 of 2019. Accordingly, the impugned judgment and decree stands modified to the extent of terms and conditions of agreement arrived at between the parties as contained in Annexure-1 to I.A.
