The petitioner apprehends his arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code.
As per F.I.R., this petitioner alongwith other coaccused persons committed the murder of son of the informant. It is submitted on behalf of petitioner that only on suspicion, petitioner has been made accused. Informant is not eye-witness of the occurrence and during course of investigation, no cogent material has come against this petitioner to show his involvement in the alleged crime. Similarly situated co-accused Pushpa Devi has been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 18.10.2017 passed in Cr.Misc. No. 43291 of 2017.

No.32338 of 2022(2) dt.10-10-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner named in the F.I.R. and as per post-mortem report, a symmetrical ligature mark over upper part of neck has been found and doctor has opined that deceased died due to strangulation. It is further submitted that the prayer for anticipatory bail of co-accused Dinesh Singh, who is Director of the school, has already been rejected. Considering the post-mortem report and the fact that petitioner is one of the teacher of the school, the prayer for anticipatory bail of petitioner is rejected.
