Petitioner seeks regular bail in a case registered for the offence punishable under Section 376, 420, 120B of the Indian Penal Code.

As per the prosecution case, this petitioner subjected the informant to repeated sexual cohabitation on the false assurance of marriage and later on he refused to marry with her and when she went to his house his family members misbehaved with her. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that it is one sided love story of the informant and when she understood that petitioner will not marry her, with a view to blackmail and put pressure on the

Patna High Court CR. MISC. No.42848 of 2021(3) dt.29-03-2022 2/2 petitioner, she filed this false and concocted cases against this petitioner and his entire family members. Petitioner claims clean antecedent and is in custody since 05.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that victim in her statement u/s 164 of the Cr. P. C. fully supported the prosecution case. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
