ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 387/2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though it is alleged that the petitioner was present at the place of occurrence, no specific overtact has been attributed to the present petitioner. It is further submitted that another similarly situated coaccused, namely, Chandra Bhushan Pandey has since been extended the privilege of bail vide order dated 03.07.2018 passed in Cr. Misc. No. 24451 of 2018 and one Chunchun Kumar has since been granted anticipatory bail in Cr. Misc. No. 47247 of 2018 vide order dated 24.08.2018.

No.61672 of 2018 (2) dt.08-10-2018 2/2 Considering the aforementioned facts and circumstances, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Muffasil P.S. Case No. 387/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
