2. The present petition has been preferred for the grant of following relief(s):

"for issuance of writ in the nature of mandamus directing the concerned Respondent to make payment of compensation with all other statutory benefits with statutory interest till the date of realization for the Land of the petitioners acquired for construction of the Nabinagar Power Generating Company for the homestead

3. Mr. Verma, has taken this Court to Annexure-4 to show that before the District Magistrate-cum-Collector, Aurangabad in Misc. Case No. 68 of 2017 (Ram Pravesh Bhagat vs. The State of Bihar) was pending till the filing of the writ petition.

4. He submits that the heirs be allowed to contest the said case, if it is pending.

5. Since, there is no affidavit on behalf of the State, the present status is not known.

6. Granting said liberty as submitted by Mr. Verma, the writ petition is disposed of.
