The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,379,385,504 and 506/34 of the IPC. The prosecution case as per the Fardbeyan of Chakradhar Mandal dated 3.9.2017 recorded by Harendra Rai, SI, Banka Police Station is to the effect that while the informant was returning after watching his agricultural field, the petitioners came near him in an intoxicated condition. It is alleged that petitioner no. 2 inflicted Khanti blow on the head of the informant causing injury and petitioner no. 1 inflicted iron rod blow on the left ear pit. When the informant fell down, they took away Rupees One Thousand from his pocket.

No.65140 of 2018(2) dt.12-12-2018 2/2 It is submitted by learned counsel for the petitioners that the chargesheet was submitted under sections 341,323,308 and 504/34 of the IPC which gets reflected from the impugned order. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent. Learned APP submits that there is specific accusation against the petitioners.

Considering the nature of accusation and the injury caused, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Amarpur (Fullidumar) P.S. Case No.418 of 2017 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
