The petitioner seeks bail in connection with Town Hajipur P.S. Case No. 817 of 2018 instituted for the offence under Section(s) 394 of the Indian Penal Code. Learned counsel for petitioner has submitted that petitioner is not named in the written report. No incriminating article has been recovered from possession of this petitioner. No TIP has been held. He further submits that the alleged motorcycle has been recovered from the house of co-accused Deepak Kumar and Ranjit Kumar.

Learned counsel for petitioner further submits that Deepak Kumar has given his confessional statement wherein he has taken the name of this petitioner alleging that planning of

Patna High Court CR. MISC. No.32050 of 2019(2) dt.14-05-2019 2/2 robbery was made in the garage of this petitioner. Petitioner is in custody since 17.11.2018 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur, Vaishali in connection with Town Hajipur P.S. Case No. 817 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
