The petitioner seeks bail in Rajpur P.S. Case No.232 of 2017, registered under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.
The petitioner is alleged to have assaulted with leg on the chest of the brother of the informant, but no corresponding injury was found. Other accused persons, namely, Vishal Choubey, Rama Kant Choubey and Srikant Choubey have been granted bail by order dated 14.12.2017, passed in Cr. Misc. No.54615 of 2017. The case of the petitioner stands on the better footing and petitioner is in jail since 11.06.2020. It appears that the petitioner is alleged to have armed with lathi but petitioner is alleged to have assaulted the brother of the informant with leg on his chest. No corresponding injury
Patna High Court CR. MISC. No.31488 of 2020(2) dt.01-12-2020 2/2 was found on the chest of the brother of the informant and the petitioner is in jail for about six months.
Considering the facts aforesaid, petitioner, namely, Dharmendra Choubey is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Buxar in connection with Rajpur P.S. Case No.232 of 2017.
