JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 30.06.2020 in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act.
In huge quantity foreign made liquor are said to be recovered from a car and petitioners were caught by the police officials while they were fleeing from getting down from the
Patna High Court CR. MISC. No.31994 of 2020(2) dt.04-12-2020 2/2 aforesaid case.
Learned counsel of the petitioners submits that petitioners are driver and moreover, they do not have any criminal antecedent and are languishing in jail custody since long.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-II, Gopalganj in connection with Mohammadpur P.S. Case No. 134 of 2020.
It is made clear that if the defects, as pointed out by the office are removed within the above stated period , the provisional bail of the petitioner shall be deemed to be confirmed.
