2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 342, 323, 325, 307, 332, 333, 353, 379, 411 of the Indian Penal Code.
3. As per prosecution case, the petitioner along with co-accused persons are alleged to have assaulted the informant and one Mukesh Kumar due to which they sustained injuries. The accused persons also snatched pistol of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant being a police officer has implicated the petitioner with ulterior motive. No specific allegation has been attributed against the petitioner to assault the informant. The alleged

No.32799 of 2023(3) dt.08-08-2023 2/2 recovery of pistol has been made from possession of co-accused Lal Mohan Goswami who is already getting the privilege of bail granted by a co-ordinate Bench of this Court vide order dt. 7.7.2023 passed in Cr. Misc. No. 38935 of 2023 hence, the case of this petitioner stands on similar footing of that of co-accused. He has got no criminal antecedent and languishing in judicial custody since 10.4.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Amarpur P.S. Case No. 618 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka.
