This application for anticipatory bail arises out of Nayagaon P.S. Case No. 109 of 2018, disclosing offences under Sections 376, 498(A), 420, 504 and 120/34 of the Indian Penal Code, Section 3 of the POCSO Act and Section 3⁄4 of the Dowry Prohibition Act.
The petitioners are brother and sister of the main accused Vicky Kumar, who is said to have sexually exploited the informant under the assurance of marrying her and subsequently they married each other.
Leaned counsel for the petitioners has submitted that
Patna High Court CR. MISC. No.30198 of 2019(2) dt.08-05-2019 2/2 these petitioners have been implicated only because they are brother and sister of the main accused Vicky Kumar. Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned 1st Additional Sessions Judge, Saran at Chapra in connection with Nayagaon P.S. Case No. 109 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
