Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in connection with Shikarpur P.S. Case No.107 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Though liquor was recovered from an open place belonging to some other person. However, it is alleged that the same was of the petitioners. Moreover, the petitioners have got criminal antecedent.

Patna High Court CR. MISC. No.41996 of 2021(2) dt.15-12-2021 2/2 Hence, In my view, this is not a fit case for grant of anticipatory bail. Accordingly, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioners within two weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
